1. Scope & General Overview
Welcome to Auralis. These Terms of Service ("Terms") constitute a legally binding agreement between you and AURALIS Wellness UG (haftungsbeschränkt) ("Auralis", "we", "us", or "our"), governing your access to and use of the Auralis mobile application, website, and related digital wellness services.
By creating an account, browsing our directories, or utilizing any features of Auralis, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our companion Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of our services.
2. 18+ Eligibility & Account Security
Mandatory Age Restriction: You must be at least 18 years of age to register or use the Auralis App. Use by anyone under 18 is strictly prohibited.
Given the unique culture of European sauna and thermal bathhouse spaces (frequently involving communal, textile-free relaxation environments), we maintain a strict 18+ age gate:
- Accurate Registration: You agree to provide truthful, accurate, and current information during registration. Providing fraudulent age or identity details is grounds for immediate termination.
- One Account Per User: Each user is permitted one personal account unless expressly authorized in writing by Auralis.
- Credential Safeguards: You are responsible for safeguarding your login credentials. You must notify us immediately at auralisapp.official@gmail.com if you suspect any unauthorized access or breach of your account.
3. Thermal Wellness & Health Disclaimer
CRITICAL HEALTH NOTICE: Auralis is an informational lifestyle and habit-tracking application. It is NOT a medical device and does NOT provide medical advice, diagnosis, or clinical treatment.
Sauna bathing, contrast heat therapy, extreme heat exposure (e.g., Finnish saunas up to 100°C), and cold water immersion (ice plunge pools) impose significant physiological demands on the human cardiovascular, respiratory, and autonomic nervous systems:
- Consult a Healthcare Professional: You should consult a licensed physician before engaging in thermal heat or cold therapy, particularly if you have cardiovascular disease, high or low blood pressure, respiratory conditions, acute infections, epilepsy, are pregnant, or take prescription medications.
- Listen to Your Body: Never push beyond your personal comfort limits. If you experience dizziness, lightheadedness, nausea, chest tightness, or disorientation, exit the sauna or cold pool immediately, hydrate, and seek medical assistance if symptoms persist.
- Recovery Scores are Estimates: Wellbeing scores and recovery suggestions generated in-app are heuristic estimations based on self-reported inputs and optional local biometric readings. They should never supersede professional medical guidance or your own physiological sensation.
- Assumption of Risk: You voluntarily assume all inherent risks associated with heat and cold exposure at thermal facilities. Auralis assumes no liability for adverse health events, fainting, dehydration, or injury resulting from sauna practice.
4. Community Standards & Anti-Harassment
Auralis was built to foster a serene, respectful, and mindful environment for sauna enthusiasts. In traditional sauna etiquette (Saunaregeln), peace, modesty, and personal boundaries are paramount.
We operate a zero-tolerance policy regarding harassment and inappropriate behavior. You strictly agree NOT to:
- Harass, stalk, intimidate, or demean any member of the community or facility staff.
- Send unsolicited, sexually suggestive, obscene, or threatening messages or images.
- Solicit romantic encounters or engage in non-consensual advances, particularly regarding naked or textile-free bathhouse settings.
- Capture or distribute photography or video recordings within private or textile-free areas of any spa facility.
- Post spam, promotional advertising, commercial solicitations, or fraudulent reviews.
Users who violate these standards are subject to immediate content removal, formal warning, suspension, or permanent account expulsion without notice.
5. User Content & Intellectual Property
A. Auralis Intellectual Property
All trademarks, visual designs, brand names, iconography ("Roasted Cedar & Linen"), software code, database architecture, and editorial guides are the exclusive intellectual property of AURALIS Wellness UG (haftungsbeschränkt). You may not copy, reverse-engineer, decompile, or create derivative works from any part of our platform without prior written authorization.
B. Your User-Generated Content
You retain full copyright ownership of reviews, comments, and profile content you submit. By posting content to public areas of Auralis (e.g., facility reviews or public group discussions), you grant Auralis a worldwide, non-exclusive, royalty-free, perpetual license to host, display, and format your content strictly within the application and website.
Private diary notes and personal recovery logs are private to your account and are never published to public community surfaces.
6. Third-Party Facilities & Schedules
Auralis provides curated directories of independent thermal facilities, public bathhouses, and Aufguss infusion schedules:
- Independent Operations: Listed facilities are operated by independent third parties. Auralis is not the owner, operator, or guarantor of any physical facility unless explicitly stated.
- Timetable Variations: While we endeavor to keep opening hours, admission rates, and Aufguss master schedules accurate, physical facilities may modify their schedules without prior notice. Auralis is not liable for schedule discrepancies, cancelled infusions, or facility closures.
- Facility Rules: You agree to abide by the specific internal house rules (Hausordnung) of any facility you visit.
7. Subscription Tiers & Billing
Auralis provides a core free service alongside optional premium subscriptions (such as Auralis Plus and Auralis Recovery):
- In-App Purchases: Paid subscriptions are processed securely through the Apple App Store or Google Play Store. Billing is subject to the payment terms and conditions of the respective platform provider.
- Automatic Renewal: Unless cancelled at least 24 hours prior to the conclusion of the active billing period, subscriptions renew automatically. You can manage and cancel your subscriptions at any time through your Apple ID or Google Play account settings.
- Feature Previews: Upcoming features marked as "coming soon" do not constitute guaranteed deliverables for active subscription terms.
8. Suspension & Account Deletion
You may terminate your account at any time through the in-app settings (Profile → Settings → Account Security → Delete Account) or by emailing auralisapp.official@gmail.com. Upon deletion, your profile will be immediately hidden and scheduled for automated GDPR anonymization within 30 days.
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if we determine that you have violated these Terms, engaged in misconduct, or if required by applicable law.
9. Warranty Disclaimers & Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AURALIS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AURALIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PHYSICAL INJURY ARISING FROM THERMAL PRACTICE, OR UNAUTHORIZED FACILITY INTERACTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Nothing in these Terms limits our liability for death or personal injury resulting from our intentional misconduct or gross negligence, or for any liability that cannot be legally excluded under German mandatory consumer protection law.
10. Governing Law & Dispute Resolution
These Terms and any disputes arising out of or related to your use of Auralis shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer residing within the European Union, you also enjoy the protection of the mandatory provisions of the law of your country of residence. The European Commission provides an online dispute resolution platform accessible at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
